| dc.description.abstract | The article is devoted to a comprehensive study of the constitutional complaint as a special human-rightsprotection institution that operates within the rule-of-law system of Ukraine and ensures the protection of the rights of individuals and citizens. The author examines the constitutional complaint not merely as a procedural means of challenging a statute, but primarily as a practical indicator of the extent to which the rule-of-law principle enshrined in Article 8 of the Constitution of Ukraine is genuinely operative, rather than a purely declarative provision of the founding act. It is precisely in this shift of research focus – from a strictly dogmatic description of the procedure to an assessment of the institution through the lens of the rule of law – that the conceptual novelty of the work lies. The legal nature of the constitutional complaint is revealed, in particular as a combination of the objective function of constitutional review and the subjective rights-protective function, as well as its subsidiary character among national remedies, whereby the complaint is directed against the unconstitutional norm being challenged rather than against the court decision as an act of law application. The two-tier normative construction of the institution, established by the 2016 constitutional justice reform (Article 55(3), Article 151-1 of the Constitution of Ukraine, and the Law of Ukraine «On the Constitutional Court of Ukraine»), is analyzed: the subjects entitled to lodge a complaint, its subject matter, admissibility requirements, and the institutional mechanism for its review. Based on a comparative-legal analysis of the normative (Ukrainian) and full models of the constitutional complaint, systemic limitations of the domestic construction are identified: above all, the narrowing of the complaint’s subject matter to a statute applied in a final court decision, the absence of any possibility to challenge subordinate (by-law) legal acts, and the problem of individually restoring a complainant’s rights, linked to the condition that review under exceptional circumstances is permitted only where the court decision remains unenforced. The analysis is illustrated by the 2024–2025 case law of the Constitutional Court of Ukraine. Directions for improving the institution are outlined in the context of Ukraine’s European integration commitments, including removing the “unenforced decision” limitation, cautiously expanding the complaint’s subject matter, and strengthening the institutional independence of the Constitutional Court under martial law | uk_UA |
