dc.description.abstract The article analyses the concept of particular content of morality in the context of judgments of the European Court of Human Rights (ECHR). The author proves that the modern understanding of morality within the framework of the application of the Convention for the Protection of Human Rights and Fundamental Freedoms is not universal, but is based on the consideration of national socio-cultural contexts, historical traditions and religious peculiarities of the participating States. In view of this, the ECtHR is developing an approach that ensures a legal balance between the needs of a democratic society and the freedoms of an individual, using the doctrine of the ‘margin of appreciation’. This approach makes it possible to interpret the provisions of the Convention in different ways, taking into account the moral and ethical views of a particular society. The study focuses on case law illustrating how the ECtHR recognises the legitimacy of various forms of moral regulation, including freedom of expression, reproductive ethics, the right to privacy and freedom of religion. The article argues that the particular content of morality does not contradict the European rights, but, on the contrary, contributes to their flexible implementation in the context of legal pluralism. The article also focuses on the dynamic nature of morality, which is recognised by the European Court of Human Rights as a factor requiring constant updating of legal approaches. Moral perceptions change in line with the transformations of the socio-cultural environment, which necessitates a flexible interpretation of the Convention's provisions. The ECtHR applies the doctrine of a ‘living instrument’, according to which the provisions of the Convention should be interpreted in the light of current conditions, and not static. This allows us to take into account changing perceptions of such components as sexual orientation, gender identity, reproductive rights, bioethical issues, etc. Thus, the particular content of morality is not fixed as an unchanging category, but is seen as the result of a constant rethinking of social norms. This approach contributes to the legitimation of judicial decisions within a multicultural Europe, ensuring a balance between individual rights and the ethical views of individual national communities. uk_UA
