The scientific article reveals the essence of the institute of international legal responsibility. Established, that International legal responsibility
is the responsibility of the subjects of this law, determined by the norms of international law, which arises for the commission of an international
legal tort. There are two different types of responsibilities. Negative liability is caused by an offense, is a tort. The law of international responsibility
is devoted to this kind. The second type is positive responsibility, which means the obligation to take the necessary measures to achieve
this goal, and this obligation follows from international law. The goals of international legal responsibility are clarified. Thus, the objectives
of international legal responsibility are: deterring a potential offender from committing an offense; motivating the offender to properly fulfill their
obligations; providing the victim with compensation for material or moral damage caused to him; influence on the future behavior of the parties
in order to fulfill their obligations in good faith. The role of this institute in maintaining the world peace of international law is analyzed, as well
as the problems related to the functioning of this institute are identified. The authors highlight the following conditions for bringing states to
international legal responsibility: 1) there must be an international legal obligation between the two states; 2) there must be an act or omission
that violates this obligation and is attributed to the responsible state; 3) the consequence of this action is loss or loss. Considerable attention
is paid to the peculiarities of the state’s responsibility for violating international obligations under the Draft Articles on the Liability of States for
Internationally Wrongful Acts Adopted by the Commission on International Law.The nature of the offenses is also analyzed and it is noted that
the main shortcoming is, in particular, the special attention to the application of countermeasures to states from the standpoint of international
organizations and the subsidiary liability of member states.
