From a scientific and practical point of view, the content of important concepts for the mediation process is revealed, namely:
“mediation”, “alternative form of conflict (dispute) settlement”, “conflict (dispute)”. “Mediation” is a commonly used term that comes
from the Latin “mediare” which means mediation. From a scientific point of view, mediation is a process that contributes to the rapid
resolution of a conflict (dispute), in which the parties, not the mediator, propose options for solving the problem, make a mutually ben
eficial decision and are responsible for its implementation. It is proved that the alternative settlement of conflicts (disputes) in the nar
row sense is understood as a non-state form of protection of citizens’ rights, in which there is an interaction of techniques (techniques)
and methods, with the help of which the parties to the conflict (dispute) reach an agreement and enter into a mutually beneficial trans
action for them without resorting to court or in a legal proceeding in the manner and within the time limits determined by the procedural
code. It was established that there is no single generally accepted definition of the term “conflict” in science; its meaning depends on
the sphere of relations in which it is studied. In general, depending on the sphere of social relations in which conflicts arise, scientists
distinguish economic, industrial, family, political, domestic, ideological conflicts, etc., therefore, the meaning of these concepts differs.
The analysis of Ukrainian legislation proved that the term “dispute” is used mainly to determine the jurisdictional way of settling a legal
dispute in court and is fixed in procedural and material norms. The article contains suggestions for improving the Law of Ukraine “On
Mediation”. The purpose of this study is a scientific and practical analysis of the institution of mediation as an alternative mechanism
for resolving disputes (conflicts) in Ukraine. The object of the research is social relations connected with citizens’ realization of the
right to use national means of legal protection, guaranteed by Art. 55 of the Constitution of Ukraine. The methodological basis of the
research is a set of general methods of scientific knowledge, as well as special methods used in legal science.
