The article is devoted to a comprehensive examination of legal nihilism
among military personnel as a manifestation of a profound moral-ethical and legal
crisis that adversely affects the state’s combat capability, discipline, and strategic
resilience. It is emphasised that conventional punitive approaches to liability for
military offences do not foster long-term motivation to comply with norms, as they
overlook the fundamental value-based orientations that determine a service member’s
willingness to act within the bounds of the law. It is highlighted that internal ethical
regulation can significantly reinforce external legal oversight, as it shapes the
understanding of honour, duty, and personal responsibility as integral components of
the military profession and the culture of service.
The mechanisms of the gradual erosion of the legal culture of military personnel
through the repetition of minor violations, the toleration of double standards, and the
absence of clear moral guidelines are revealed. It is determined that these processes
create a favourable environment for the development of systemic nihilism, which
undermines trust in the command structure and reduces the effectiveness of legal
norms. It is found that the integration of military ethics and the concept of ethical
leadership into training and management is capable of transforming behavioural
patterns, turning legal norms into an internal need rather than merely a formal obligation.
Particular attention is paid to the necessity of incorporating a moral-ethical
component into the administrative-legal reform, which should encompass the renewal of educational programme content, the establishment of independent ethical
institutions, the introduction of procedures for assessing the integrity of command
personnel, and the improvement of mechanisms of liability for military offences in
accordance with international standards. It is substantiated that the combination of
ethics and law creates an effective preventive model that strengthens discipline,
increases trust within the military organisation, ensures its conformity with
international standards of humanity, professionalism, and responsible use of force, and
also serves as a strategic factor in national security and the legitimacy of military power
in a democratic society. For the first time, the article systematically substantiates the
integration of the moral-ethical component into administrative-legal reform as a
preventive mechanism for counteracting legal nihilism among military personnel.
